Age Dependent Relative Visa
(Subclass 838)
This is an onshore permanent visa for a single older person stay in Australia if they financially rely on a relative who is an Australian citizen or PR.
Aged Dependent relative visa - Subclass 838 is an onshore permanent visa, which can be applied onshore. It can be alternative to parent visa as well incase parents are not satisfying balance of family test.
Eligibility
​1. You must be sponsored by an eligible relative or a relative's partner.
Application is required to be sponsored. includes the parent, child, brother/sister, grandparent or grandchild, aunt or uncle, niece or nephew.
2. You must be old enough to receive old age pension in Australia.
Pension age varies between 65 – 67 years depending upon your date of birth.
3.You must have been financially dependent on your relative in Australia for at least 3 years before you apply for the visa.
Financial dependency is mandatory, in which funds have actually been sent to the dependent relative on a regular basis over a reasonable period of minimum 3 years.
4. You must have no partner.
You need to prove with documentary evidence to department that you are single as a result of divorce, death or never in relationship.
4. You must be able to obtain assurance of support.
An acceptable Assurance of support must be provided, including the lodgement of a monetary bond, in order for the visa to be granted. This monetary bond is $5,000 for the primary visa applicant and $2,000 for any adult secondary visa applicant, for period of 2 or 4 years, for purpose of this visa.
5. You must meet health and character requirement.
You will be required to undergo medical assessment and no health waiver is available for this visa subclass. Also, character requirement should be met in order to visa be granted.
It is an onshore permanent visa, visa applicant must be in Australia, when visa is granted. Applicant will be eligible for bridging visa while application is being processed.
